Terms of Use

These Terms set out the rules for using stormstoke and what you can expect from us. They are written to be read, so please take a few minutes.

The short version

  • stormstoke is free to use. Accounts are for people 16 and older.
  • Forecasts and alerts are model estimates. Never rely on them for safety; check official avalanche, weather and road sources and the resort.
  • Use stormstoke for yourself. Don’t scrape it, abuse it or try to break it.
  • You can stop using stormstoke and delete your account any time.
  • Alberta law applies, but consumers keep the protections their local laws give them.

1. This agreement

These Terms of Use (“Terms”) are an agreement between you and Matt Dyck, Calgary, Alberta, Canada, who operates stormstoke (“stormstoke”, “we”, “us”). They cover stormstoke.com, demo.stormstoke.com, our emails and any stormstoke app (together, the “Service”).

By using the Service or creating an account, you agree to these Terms. Our Privacy Policy explains how we handle your information. If you do not agree, please do not use the Service.

2. Who can use stormstoke

You can browse stormstoke without an account. To create an account you must be at least 16 years old and able to agree to these Terms. You may use the Service only where it is lawful for you to do so.

3. Forecasts are estimates, not safety advice

Snow forecasts, recent-snow estimates, storm alerts and resort details on stormstoke are computer model estimates and directory information. They can be wrong, incomplete, out of date or late. Mountain weather changes quickly and actual snowfall at a resort often differs from any forecast.

  • Do not rely on stormstoke for decisions about your safety. It is not an avalanche forecast, a road report or an official weather warning.
  • Before you travel or ride, check official sources: national weather services, avalanche forecasts (such as Avalanche Canada and US avalanche centers), road and highway reports, and the resort itself.
  • Lift, trail, opening and operations information comes from third-party directories and may not be current. Confirm with the resort.
  • Skiing, snowboarding, backcountry travel and winter driving carry inherent risks. You are responsible for your own decisions and safety.

The demo replays archived forecasts from a past winter and does not show current conditions.

4. Your account

  • Give a real email address you control, and keep access to it secure. You are responsible for activity on your account.
  • Accounts are personal. Do not share sign-in codes or create accounts for others without their permission.
  • Tell us at snow@stormstoke.com if you think someone else has accessed your account.
  • You can delete your account at any time from the Account screen.

5. Storm alerts and emails

Storm alerts are sent automatically when forecasts for resorts you follow cross the thresholds you set. Alerts can be delayed, missed, sent more than once or sent when snow does not arrive, for example when forecasts change or a provider is down. We do not guarantee that any alert will be sent or received.

You can change thresholds, pause alerts or stop emails at any time in Snow alert settings or with the link in any alert. We will also send essential service messages, such as sign-in codes and notices about changes to these Terms or the Privacy Policy.

6. Acceptable use

Please use stormstoke for your own, personal, non-commercial use. You agree not to:

  • copy, scrape, harvest or bulk-download forecasts, the resort directory or other content, or use it to build a competing product or dataset, except as allowed by the open licences listed in section 8;
  • overload, disrupt or try to get around rate limits, security or access controls, or probe the Service for vulnerabilities without our written permission;
  • access the Service with bots or automated tools, other than standard search engine crawlers;
  • send spam, malicious code or unlawful, abusive or misleading content through feedback or any other feature;
  • impersonate anyone or misrepresent your connection with anyone; or
  • use the Service in breach of any law.

7. The Service is free and may change

stormstoke is currently free. We may add, change or remove features, limit use, or suspend or end the Service, in whole or in part, at any time. If we introduce paid features, we will tell you the price and terms before you are charged, and nothing will be charged without your agreement.

If we plan to shut down the Service, we will try to give account holders reasonable notice by email.

8. Our content and third-party content

The stormstoke name, logo, design, software and original text are owned by us and protected by law. These Terms give you a personal, revocable, non-transferable right to use the Service as intended; they do not transfer any ownership to you.

Some content comes from others and stays subject to their terms:

  • Weather data from Open-Meteo, licensed under CC BY 4.0.
  • Map, ski area and lift data from OpenStreetMap contributors (Open Database License), OpenSkiMap and Skimap.org, and map shapes from Natural Earth.
  • Photographs credited on each page, under the licences shown there.
  • Resort names and logos, which belong to their owners. Showing them does not mean any resort endorses or is affiliated with stormstoke.

Links to resort and other websites are for convenience. We do not control those sites and are not responsible for them.

9. Feedback

We welcome ideas and feedback. If you send any, you allow us to use it to improve stormstoke without owing you anything. Please do not send confidential information through feedback.

10. Suspension and ending

You can stop using stormstoke and delete your account at any time. We may suspend or close an account that breaks these Terms, puts others or the Service at risk, or has to be closed by law. Where reasonable, we will tell you why and give you a chance to respond. Sections 8, 9 and 11 to 14 continue to apply after your use ends.

11. Disclaimers

To the extent the law allows, the Service is provided “as is” and “as available”. We do not promise that it will be accurate, complete, timely, uninterrupted or free of errors, or that forecasts or alerts will match actual conditions. We disclaim all implied warranties and conditions, including of merchantability, fitness for a particular purpose and non-infringement.

12. Limits on liability

To the extent the law allows, stormstoke will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost trips, travel or lodging costs, lift tickets, lost profits or lost data, arising from or related to the Service or these Terms, even if we were told such damages were possible.

To the extent the law allows, our total liability for all claims about the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the claim and CAD $50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence, intentional misconduct, or death or personal injury caused by negligence where the law does not allow it to be limited.

13. Responsibility for misuse

To the extent the law allows, if you use the Service in breach of these Terms or the law, you will cover reasonable losses and costs (including legal fees) that we incur from third-party claims caused by that misuse. This does not apply to consumers where local law does not permit it.

14. Governing law and disputes

Please contact us first at snow@stormstoke.com; most concerns can be resolved quickly that way.

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Disputes will be decided by the courts of Alberta, sitting in Calgary.

If you are a consumer living in the European Union, the United Kingdom or another place whose laws give you mandatory protections, you keep those protections, and you can also bring a claim in the courts where you live. EU consumers can also use the European Commission’s online dispute resolution information at consumer-redress.ec.europa.eu.

15. Apps from app stores

If you get a stormstoke app from the Apple App Store or Google Play, these Terms apply to it, together with the store’s own terms. For apps downloaded from the Apple App Store:

  • These Terms are between you and stormstoke only, not Apple Inc. (“Apple”). stormstoke, not Apple, is responsible for the app and its content.
  • Your licence is limited to using the app on Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
  • stormstoke is solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support.
  • To the extent any warranty applies by law, if the app fails to conform to it you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are stormstoke’s responsibility, subject to these Terms.
  • stormstoke, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
  • If a third party claims that the app or your use of it infringes their intellectual property rights, stormstoke, not Apple, is responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must follow any applicable third-party terms when using the app, such as your mobile carrier’s terms.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Changes to these Terms

We may update these Terms as stormstoke changes or the law requires. We will post the new version here with a new date. For significant changes, we will email account holders at least 14 days before they take effect, unless the change is needed sooner for legal or security reasons. If you keep using the Service after a change takes effect, the updated Terms apply. If you do not agree, you can delete your account.

17. General

These Terms and the Privacy Policy are the whole agreement between you and stormstoke about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we have not given up the right to enforce it later. You may not transfer these Terms without our consent; we may transfer them to a business that takes over stormstoke, and we will tell you if that happens.
